Acceptance and who we are
These Terms of Use ("Terms") are a legal agreement between you and Matelias LLC, a California limited liability company that operates tendbean ("tendbean," "we," "us"). By using the tendbean website or joining our waitlist, you agree to these Terms. If you don't agree, please don't use the site.
Scope
These Terms govern the tendbean marketing website and the email waitlist only. They are not a licence to any app. The tendbean app is not available yet; when it launches, separate terms will govern it.
Eligibility
You must be 18 or older to use this site and to join the waitlist. By joining, you confirm that you are.
The waitlist
Joining the waitlist means we'll email you about tendbean, including when it launches. The waitlist is double opt-in: after you sign up, we send a confirmation email, and you're only added once you confirm. You can unsubscribe at any time using the link in any email we send you.
Waitlist perks
We may offer promotional perks to people who join the waitlist. As things stand, the first 100 confirmed signups are "founding" members (a free month of Premium), and everyone after gets an "early" perk (early access plus two weeks of Premium).
These perks are promotional. They may change or be withdrawn, and they depend on the product actually launching. They carry no cash value and are non-transferable. We don't guarantee any launch date or that tendbean will be available in any particular place or time.
Forward-looking statements
tendbean is in development. Anything described on this site — features, perks, timing — may change, and may never ship. Descriptions of what tendbean will do are plans, not promises.
Health disclaimer
tendbean is a general wellness and informational product. It is not a medical device, and nothing on this site is medical advice.
The site shows an illustrative "On track for her age" indicator that references feeding and growth. Any reference to feeding, sleep, or growth ranges is general information drawn from publicly available guidance, such as materials published by the CDC. It is not a clinical assessment, a diagnosis, or a screening.
Using this site creates no doctor-patient relationship. Always consult your pediatrician about your child's health. Never disregard professional medical advice, or delay seeking it, because of something you read here.

Acceptable use
When using this site, you agree not to:
- scrape or harvest content from the site;
- submit signups through automated means, or in bulk;
- submit an email address you don't control;
- circumvent our rate limits or any security controls.
Intellectual property
The content on this site, along with the tendbean name and logo, is owned by us. We grant you a limited, personal licence to view the site for your own, non-commercial use. All other rights are reserved.
Third-party links
The site may link to third-party websites. We don't control them and aren't responsible for their content or practices. Visiting them is up to you.
Disclaimer of warranties
The site is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the site will be uninterrupted, error-free, or secure.
Limitation of liability
To the fullest extent allowed by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or goodwill, arising from your use of the site. Some states do not allow certain exclusions or limitations, so some of the above may not apply to you.
Indemnification
You agree to indemnify and hold harmless us and our members from any claims, losses, or expenses arising out of your use of the site or your breach of these Terms.
Termination
We may remove anyone from the waitlist, or limit access to the site, at any time and for any reason.
Changes to these terms
We may update these Terms. When we do, we'll update the date at the top. Continuing to use the site after a change means you accept the updated Terms.
Governing law and venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be brought in the state courts located in San Diego County, California, and you consent to their jurisdiction.
